Moderation Policy

All Open Bazaar buyers and sellers who choose to use us for moderation will be bound by this agreement.

Returns

7 day return policy. If a buyer has a problem with the item received, we must be contacted within 7 days to initiate a return. The buyer will be responsible for the return shipping fees.

If it is the fault of the buyer (Ordered the incorrect item, changed mind), the buyer may be eligible to pay a restocking fee of up to 15%.

If it is the fault of the seller (DOA, faulty, damaged or incorrect item sent), the buyer will pay the return shipping fees and when the parcel is returned to the seller, the buyer will get a 100% refund/exchange.

The following items are not eligible for return:

-Digital goods

-Perishable goods which have been opened or have an expiry date of less than 2 months


 

 

Releasing The Escrow

Once the tracking shows that the order has been delivered, if there is no contact from the buyer within 7 days (After the eligible return period) we will automatically release the Bitcoin to the seller.


 

 

Lost / Missing Packages

Domestic deliveries:

If the tracking shows that the item was sent but not delivered and a working tracking number has not been updated for 10 days, the package will be considered lost/missing and the buyer will be awarded the escrow.

If the buyer is not contactable (does not reply to our request within 5 working days), the seller will be awarded the escrow.

International deliveries:

If the tracking shows that the item was sent but not delivered and a working tracking number has not been updated for 30 days, the package will be considered lost/missing and the buyer will be awarded the escrow.

If the buyer is not contactable (does not reply to our request within 5 working days), the seller will be awarded the escrow.


 

 

Dispute Resolution

In the case of a dispute, both sides will present us their evidence. We will with reasonable effort attempt to reach a mutually agreed resolutions.

If no resolution can be agreed upon then the evidence will be weighed and a decision will be made. If it is not clear whom the rightful party is then funds will be split based on the assessment of the moderator.


 

 

 

 

Digital Delivery Disputes

In order to properly moderate transactions involving digital delivery, a method to prove transfer to buyer is necessary. All information required to prove transfer should be included within the transaction.

It is the seller’s responsibility to make sure the method and information are available and documented within the transaction.


 

 

Abandonment

Unless otherwise stated, failing to respond for 3 days during an active dispute will result in forfeiture of the dispute.


 

 

Legality

Moderation will be refused for any transaction prohibited by the regional laws of any party. In cases of refusal, it will be left to the buyer and seller to resolve the dispute. Moderator is located in South Africa.
